Family Law Arbitration Perth Clients Can Rely On In Any Matter
What can be arbitrated?
Only property and financial matters can be arbitrated – not parenting matters. You can also choose to arbitrate only part of a matter – for example, if you and your former spouse agree on how to divide your assets but can’t agree on spouse maintenance, you can just arbitrate the spouse maintenance component, or if you can’t agree on the value to be attributed to a house you could have an arbitrator determine that for the Judge to use in the overall proceedings.
Book a No-Obligation ConsultationHow Do Arbitration and Mediation Differ?
Whilst mediation and collaborative practice are similar in a number of ways, in particular, each seeking to resolve disputes without litigation, there are some differences. The most notable being that as a mediator is a neutral party, they maintain a balanced approach while assisting clients to make up their own decisions. They do not advocate for any one of you. Conversely, collaborative lawyers act or advocate for each of their respective clients.
MediationCUTTING THROUGH TO A FAIR SOLUTION
Common in commercial law, but perhaps under-utilized in Family Law, the process of arbitration provides a dispute resolution format which can help you work your way towards a binding decision without going through the family court system.
WHAT IS ARBITRATION AND WHAT ARE THE BENEFITS?
Arbitration is similar to mediation in terms of process, but the parties in an arbitration hand the difficult decisions on the key aspects of a settlement to an independent third-party, qualified arbitrator.
Handing over the deciding voice to an external party can allow you and the other party to benefit from the process in a number of ways: greatly reduced financial, emotional and legal costs of litigation; greater choice on who decides your dispute, and how they make that decision; setting your own timeframes for settlement of your dispute; generally faster resolution of your dispute; and avoiding your private details from being aired in a public forum (via case listings and judgements).
